Reported in ST today - may settle out of court. Also reported probably by December, Microsoft coming out with their MP3 player to challenge Apple i-pod. May affect Creative Zen MP3 badly. |

Creative shares gained on speculation that it will soon settle its dispute against Apple over patent infringements. I doubt it's true. It's going to be a long drawn-out affair. |

Apple launched a 2nd patent-infringement lawsuit against Creative. It also filed a trade complaint with the US International Trade Commission, seeking a halt in US exports of Creative's MP3 players. Apple's actions are clearly to drain Creative's resources. |

I think from creative's point of view, its a fight for not only profits, but also survival in this dog eat dog world. Also, legal justice that's meted out may not necessarily be moral justice - as you mentiioned about eBay. |

Besides Apple, Sim Wong Hoo has also threatened to go after other MP3 makers that may be infringing on its navigation patent. There may be a lot of infringers. Apple is unlikely to give up this lucrative business (50m iPods sold since 2001) without a long expensive fight, time and money that indebted loss-making Creative cannot afford to waste. While the end-rewards may be significant, as seen in the US$612.5m that Research-in-Motion paid NTP this year to settle its Blackberry patent infringement suit, the relief will certainly not be immediate and take a long time to materialise. The recent unanimous US supreme court decision to overturn the injunction on eBay against using someone else's technology despite found guilty will make it difficult to prevent Apple from selling iPods even if it is found guilty. |
