To most people, DBS Bank got off lightly for the seven hour breakdown of its online and branch banking systems on July 5. Perhaps too lightly, for the amount of inconvenience and embarrassment caused by rejected credit cards and not being able to draw cash from the bank’s 1,000-odd ATM machines across the island.

However, MAS clarified that current laws [?] do not allow the authority to impose a fine on our banks for such infringements, although they can be subject to financial penalties such as having to set aside more money to cover risks — meaning, they cannot lend out that sum of money to make more money.

In any case, how large a fine can anyone impose on a financial institution, without hurting innocent stakeholders, including customers and shareholders?

A fIne also does little to assuage a wronged, inconvenienced or dissatisfied customer as it just ends up in the kitty of the authorities, and not the people who suffered.

Perhaps there should be a review of the rules regarding similar infringements of Internet banking and technology risk management guidelines, with some emphasis on speedily compensating affected customers without the need to engage in costly lawsuits.

MAS should also be able to extend its reach to take appropriate action against vendors and others involved in providing financial hardware and software services, including those providing outsourced services.

To some extent, the ball is in DBS Bank’s court to assuage its stakeholders. True, DBS chief executive Piyush Gupta has offered his apologies several times over the past month for the inconvenience caused.

But is an apology enough to satisfy all customers?

Yes, it will be difficult to ascertain who actually suffered on that fateful July day. Still, a simple gesture of goodwill — say, an ice cream or a chocolate bar for all customers on a particular day — could go some way to recovering lost goodwill.

Or, DBS could make an appropriate donation to some charity or organisation in the name of all wronged or inconvenienced customers.

Tiger Airways back in the BLACK

Budget airline Tiger Airways is back in the black in its fiscal first quarter, overturning the loss of $6 million in the period a year ago, to post a net profit of $1.9 million.

Meanwhile, the carrier’s revenue rose 45 per cent to $145 million.

Tiger said strong passenger growth, unit revenue increases and continued strict cost control led to the profitable results.

Its President and CEO, Mr Tony Davis says the carrier is capitalising on the strong economic growth and visitor arrival data out of Singapore by increasing its Singapore fleet by some 40 per cent over the next six months.

Tiger is banking on its proposed partnership with Thai Airways, announced earlier this week, to establish a new low-cost airline based in Thailand called Thai Tiger.

SMOG gets in HK eyes

Bill introduced to curb idling enginesHong Kong recorded “very high” air pollution yesterday, prompting an environmental advocacy group to demand the government move more quickly to address the problem.

The Air Pollution Index readings were 123 in Central district and 109 in Mong Kok in the late morning, according to the Environmental Protection Department.

Readings above 100 trigger a government warning for people with heart or lung illnesses to avoid prolonged stays in heavy traffic areas. Hong Kong’s air pollution was the worst on record during the six months ended March.

In response to a public outcry, the government has introduced a Bill proposing a ban on idling engines, among other measures. “Air pollution in Hong Kong is getting worse as roadside emissions are steadily growing,” said Ms Erica Chan of the independent advocacy group Clean Air Network.

The new Bill will propose a HK$320 ($55.71) fine for drivers who leave their engines idling for more than 3 minutes.

Campbell did get ‘dirty stones’

But she stopped short of saying they were diamonds or that she was given the gift by Taylor himself.

Ms Campbel l was being questioned about claims made by actress Mia Farrow that Taylor gave the model an uncut diamond or diamonds after a dinner party hosted by former South African President Nelson Mandela that they all attended in 1997. Prosecutors say, if true, the story would provide evidence that Taylor received socalled “blood diamonds” in return for arming rebels who murdered, raped and maimed Sierra Leone civilians during the 1991-2001 civil war.

The model told the court she was awakened in the middle of the night after the dinner party by two men at her door, who offered her a pouch they said was a gift for her. She said she frequently receives gifts from admirers and did not look at it until the following morning.

“I saw a few stones in there. And they were small dirty-looking stones,” she said, adding that “there was no explanation, no note”.

At breakfast the following day, she said either her former agent Carole White or Ms Farrow told her the rocks must be diamonds and were probably a gift from Taylor.

Ms Campbell said she then gave them to a friend, Mr Jeremy Ratcliffe, who at the time was the director of Mr Mandela’s children’s charity. The model’s testimony comes after a lull in media interest in Taylor’s three-year-old trial on 11 counts of war crimes and crimes against humanity.

She had declined to cooperate with prosecutors, citing fears for her family’s safety, until judges last month ordered her to appear or face a maximum sentence of seven years for contempt.

Ling’s arrest leaves us all guessing

Election ploy or sign of a shift for Umno?

He is being tried for deceiving the Malaysian Cabinet in 2002 into agreeing to a land purchase for the Port Klang Free Zone project (PKFZ) by withholding highly relevant information about interest rates which, if known to the Cabinet, would have led it — according to the prosecution — to deny consent for the deal.

The sense of public disbelief caused by the case is not because Malaysians feel that Attorney-General Abdul Gani Patail does not have a case, or that Ling is being unjustly accused. On the contrary, few doubt that the ballooning cost of the PKFZ project needs investigating, and a lot of explaining still needs to be done by the government.

Cynical by nature, especially where politics are concerned, Malaysians have reacted with uncharacteristic reserve to the news that the Najib Razak administration is moving against one of the major figures from the Mahathir period.

Why now?  Why him?

Even the opposition is lost for words, and its leaders are wisely taking a wait-and-see attitude towards the case. Easy associations are being drawn to the cases of Mr Eric Chia, the former Perwaja Steel managing director, and Mr Kasitah Gaddam, former Land and Cooperative Development Minister. Both were hit with bribery charges in February 2004 by former Malaysian Prime Minister Abdullah Badawi. Both have since been acquitted.

The question being asked now is if Ling’s case is a similar show orchestrated by the current Prime Minister for a demanding public, and in light of strong rumours that a snap election is on the way.

Be that as it may, Malaysians have reason to rejoice over the fact that public demand for accountability in governance does actually have an effect. Not only is the cyberspace activism that has been growing over the last decade now very much a potent part of Malaysian politics, the fact that the ruling coalition, after 50 years at the helm, no longer feels that power is its god-given right, bodes well for the future.

The charge against Ling potentially opens a can of worms — though as yet, there is no hint of how great the consequences are going to be. He was after all a trusted figure during the Mahathir years. When the dominant United Malays National Organisation (Umno) was split by internal conflicts in 1988 and former Premier Dr Mahathir Mohamad was in danger of losing power, Ling acted for a time as the president of the Barisan Nasional (BN).

The phrasing of the charge against Ling also leads to queries about how naive and innocent the rest of the 2002 Cabinet were.

Was everyone ignorant of what was going on?

Is this the only case where the alleged criminal method was practised, either by Ling or by anyone else in a ministerial position?

 Will others be implicated soon?

Or is this the whole show?

In any case, some key members of the old Cabinet will have to be called to the stand to testify against their former colleague when the trial gets going. This includes Dr Mahathir himself. Ling has always been considered a powerful behind-the-scenes player in the MCA.

The party is in a bad way at the moment.

Along with other BN allies, it has failed to rejuvenate itself after suffering bad losses in the last general election. It has also just emerged from a painful internal struggle that has left it vulnerable.

The arrest is bound to cause confusion in the party ranks and severely test the relationship between the present leaders of the MCA and Umno.

Some wonder if this is an early sign that Umno has given up on winning back a significant number of Chinese votes, and is instead coldly contemplating the feasibility of a unity government built on cooperation between Umno and the Parti Islam SeMalaysia. If so, then the basic structure of Malaysian politics will undergo yet another revolution.

Whatever the hidden details are surrounding Ling’s arrest, the uncertain nature of politics will continue for some time to come.Corruption charges being brought against Ling Liong Sik, the former Malaysian Minister of Transport and head of the powerful Malaysian Chinese Association (MCA), have left Malaysians stunned.

THE DEAN THEY WON’T FORGET

I have been VERY FORTUNATE to have encountered some extraordinary men and women, one of whom was my former Dean at the NUS Business School, Professor Christopher Tang. He was an ordinary child from a poor family but there was nothing ordinary about what happened to him after that.

He was able to get into an excellent university in the United Kingdom, worked to support himself and later graduated with a doctorate from Yale University.

Today, he is one of the top in his field in the world. But he always finds time to help others and is extremely generous with his time and money.

I had the honour of serving under him as the Vice-Dean and we became great friends. It was clear that he was financially worse off during his time here than at the University of California, Los Angeles, where he was a chaired professor and senior associate dean.

He asked to forgo his bonuses, so that there was more for others. He gave up lucrative consulting — and he was consulting for some of the top US corporations — so that he could devote more time to managing the school.

He passed on the opportunity to become an editor for arguably the top academic journal in his field because he felt it would mean less time for the school.

He made it a point to know every person in the school, including the contracted cleaners.

He regularly used his own money to buy “thank you” meals for others, including the most junior staff.

It is not surprising that six years after he returned to the US, his name still comes up regularly in conversations and along the school’s corridors.

I spend a great deal of my free time in the charity sector. There are other things I could do that would make me financially richer, but POORER as a PERSON. What I can do is miniscule compared to the Buffetts and Gates of the world but I know that if everyone were to do just a bit more for those in need, it would make a big difference to them.

Mr Buffett said his PHILANTHROPY is driven by GRATITUDE and NOT GUILT.

I hope that as we become more affluent and have better access to education and healthcare, we do not forget to help those who are poor, have little education or are sick. It may help to remember this: It could have been me.

In a recent interview published in the

Ms Chew Gek Kim, deputy chairman of the Tan Chin Tuan Foundation, made a similar point when she spoke about a paraplegic whose husband had left her, who had lost both legs and a young son to illness and today runs the Society for the Physically Disabled in Perak.

Ms Chew said: “It is humbling when I know I could be her. After all, who can choose when or where they are born, and who their parents are?”

The TRUTH is, there is a fine line between

the rich and the poor,

the well-educated and the poorly-educated,

the healthy and the sick.

I often reflect on how things might have been. There were occasions when I could have died or been maimed in an accident or from illness, when I was young.

When my wife was carrying our first child when we were living overseas, a truck on a highway turned her car into a total wreck — just a few metres more and it would have gone over a cliff. She emerged miraculously with just a fractured wrist.

My POINT is that in our life journey, little decisions and events can dramatically change what happens to us, for better or worse.

The person cleaning the toilets in your swanky building on Shenton Way could have been me — or you.Business Times headlined “The Art of Giving”,
